This Liability Waiver and Release ("Waiver") is entered into between Align Collab Pty Ltd ABN 83668377848 (address 18 Barlow Boulevard Gables, NSW 2765) ("the Studio") and the undersigned participant ("Participant"). This form must be read, understood, correctly completed and accepted as indicated by properly signing, prior to participating in any Align Collab activity. If you are under 18 referred to as a Minor, you will need to have a parent or guardian who is over 18 sign on your behalf and provide contact details. Access to Align Collab activities is by payment and subject to Align Collab discretion. By participating in any Align Collab activity you accept the rules and regulations including participating in a safe manner. 

Acknowledgment of Risks:

The Participant acknowledges that engaging in physical activities, including but not limited to yoga, Pilates, and related fitness activities, involves certain inherent risks, including the risk of personal injury, illness, and property loss. The Participant understands and acknowledges these risks.

Assumption of Risks:

The Participant voluntarily assumes all risks associated with participating in classes, sessions, or activities conducted by the Studio. This includes, but is not limited to, the risks of injury, illness, or harm resulting from the use of equipment, facilities, or participation in classes.

Release of Liability:

The Participant, on behalf of themselves and their heirs, assigns, executors, and administrators, releases and discharges the Studio, its owners, instructors, employees, and representatives from any and all claims, demands, actions, or causes of action, whether for personal injury, property damage, or other loss, arising from or related to the Participant's participation in Studio activities.

Minor Participants (Under 18):

If I am under the age of 18, I acknowledge that my parent or legal guardian has read and agreed to the terms of this Liability Waiver and Release on my behalf.

Pregnant Participants:

If I am pregnant or become pregnant while participating in classes, I understand that it is my responsibility to consult with a healthcare provider before continuing to participate. I agree to inform the instructor of my pregnancy and follow their guidance on appropriate modifications during classes. Certain classes are not suitable during pregnancy. For Pilates classes, if you have had no complications and have been advised by your doctor that you are capable and healthy, you are welcome to attend our Reformer Align classes throughout the duration of your pregnancy.

Waiver of Claims:

The Participant waives any and all claims, whether based on negligence, breach of contract, or otherwise, against the Studio, its owners, instructors, employees, and representatives, arising from or related to the Participant's participation in Studio activities.

Indemnification:

The Participant agrees to indemnify and hold harmless the Studio, its owners, instructors, employees, and representatives from any claims, demands, or actions brought by third parties arising from or related to the Participant's actions or conduct during Studio activities.

Medical Clearance:

The Participant affirms that they have obtained medical clearance from a qualified healthcare provider and have disclosed any medical conditions, injuries, or limitations that may affect their ability to safely participate in Studio activities.

Photographic and Video Consent:

The Participant grants the Studio the right to use photographs, videos, or other media in which the Participant may appear for promotional, marketing, or educational purposes without compensation.

Entire Agreement:

This Waiver constitutes the entire agreement between the Participant and the Studio, and supersedes any prior understandings, agreements, or representations.

Governing Law:

This Waiver shall be governed by and construed in accordance with Australian laws.

Acknowledgment of Understanding:

The Participant acknowledges that they have read this Waiver, understand its terms, and agree to be bound by it. The Participant acknowledges that they have had the opportunity to seek legal counsel before accepting these terms.
